Welcome to Moana Nui Wear.
These Terms of Service ("Terms") apply to your use of the Moana Nui Wear website and to purchases made through our online store.
By accessing our website, placing an order, or using our services, you agree to these Terms. Please read them carefully before making a purchase.
Moana Nui Wear is a New Zealand-based online apparel business offering clothing and related products, including products that may be produced on demand and products held in stock.
Nothing in these Terms is intended to exclude, restrict, or limit any rights you may have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable law, where those rights cannot legally be excluded or limited.

Moana Nui Wear may operate through third-party suppliers, manufacturers, fulfilment providers, payment providers, delivery companies, and other service providers to fulfil customer orders.
2. Using Our Website
You may use our website for lawful purposes and in accordance with these Terms.
You must not:
-
use the website for unlawful or fraudulent purposes;
-
attempt to gain unauthorised access to our website, systems, accounts, or data;
-
interfere with the operation or security of the website;
-
introduce malicious software or harmful code;
-
copy, reproduce, modify, distribute, or commercially exploit our website content without permission; or
-
use our website in a way that could damage, disable, overburden, or impair its operation.
We reserve the right to restrict or terminate access to our website where reasonably necessary to protect our business, customers, website, or systems.
3. Products and Product Information
We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements, materials, sizing information, and other product information displayed on our website are accurate and current.
However:
-
colours may appear differently depending on your device or screen;
-
minor variations may occur between products;
-
measurements may have reasonable manufacturing tolerances;
-
product images may include presentation or styling elements that are not included with the product; and
-
product specifications may occasionally change where necessary due to supplier, manufacturing, availability, or production requirements.
Where a product is described as having a particular material, feature, design, or specification, we will endeavour to ensure that the product supplied corresponds with that description.
Nothing in this section limits your rights under applicable New Zealand consumer law.
4. Product Availability
Products displayed on our website are subject to availability.
A product being displayed on the website does not necessarily guarantee that it will remain available.
We may update, discontinue, replace, or modify products from time to time.
If we are unable to supply an accepted order, we will contact you and, where appropriate, provide a suitable remedy, including a refund where required.
We will not knowingly accept payment for products that we do not intend to supply.
5. Print-on-Demand Products
Some Moana Nui Wear products are produced on demand after an order has been placed.
This means that production may not begin until payment has been successfully received and the order has entered our fulfilment process.
Because print-on-demand products are produced specifically in response to an order, customers should carefully check:
-
product;
-
size;
-
colour;
-
quantity;
-
shipping address; and
-
other order details
before completing their purchase.
Where a customer simply changes their mind or selects an incorrect size, colour, or product, cancellation or return rights may depend on whether production has commenced and on the applicable return policy.
However, nothing in this section removes or limits any consumer rights that apply where a product is faulty, damaged, incorrectly supplied, not as described, or otherwise fails to meet applicable legal guarantees.
6. Stocked Products
Some Moana Nui Wear products may be held in stock and dispatched from available inventory.
Stocked products may be subject to different processing and dispatch times from print-on-demand products.
Where an order contains both stocked and print-on-demand products, the products may be dispatched separately depending on fulfilment requirements.
Any applicable shipping or processing information presented at checkout will form part of the order information provided to you.
7. Placing an Order
When you place an order through our website, you are making an offer to purchase the products selected by you.
Your order is subject to:
-
product availability;
-
successful payment;
-
accurate order information; and
-
our ability to fulfil the order.
An order confirmation email acknowledges that we have received your order. It does not necessarily mean that the order has entered production or been dispatched.
We may contact you if there is an issue with your order, including a payment problem, product availability issue, address problem, or other circumstance affecting fulfilment.
8. Pricing
All prices displayed on our website are stated in New Zealand dollars (NZD) unless otherwise indicated.
Prices may change from time to time. Any price change will not affect an order that has already been accepted and paid for, except where correction is required because of a genuine pricing or system error.
We take reasonable care when displaying prices. If a genuine and obvious pricing error occurs, we may contact you before fulfilment to explain the error and discuss the available options.
Any applicable taxes, delivery charges, or other costs will be displayed or communicated before you complete your purchase where reasonably practicable.
9. Payment
Payment must be successfully received before an order can enter production or fulfilment, unless otherwise agreed by Moana Nui Wear.
Payments may be processed through third-party payment providers.
We do not ordinarily receive or store your complete payment-card details where those details are processed directly by a third-party payment provider.
You must provide accurate billing and payment information and must have authority to use the payment method provided.
If a payment is declined, reversed, disputed, or otherwise not successfully completed, we may suspend or cancel fulfilment of the order until the payment issue is resolved.
10. Order Changes and Cancellations
Please check your order carefully before submitting it.
If you need to correct an order, contact us as soon as possible at:
For print-on-demand products, we will make reasonable efforts to accommodate a cancellation or change request if production has not yet commenced.
Once production or fulfilment has commenced, we may be unable to make changes to the order.
However, this does not remove any rights you have under applicable New Zealand consumer law.
Where an order cannot be cancelled because production or fulfilment has already commenced, this does not prevent you from seeking an appropriate remedy where the product is faulty, damaged, incorrectly supplied, not as described, or otherwise does not meet applicable legal guarantees.
11. Shipping and Delivery
We aim to process and dispatch orders within the timeframes stated on the website or at checkout.
Delivery times are estimates unless a specific delivery date has been expressly agreed.
Delivery may be affected by:
-
production times;
-
order volume;
-
weekends and public holidays;
-
courier or postal delays;
-
weather or natural events;
-
customs processing;
-
international border requirements; or
-
other circumstances outside our reasonable control.
Once an order has been dispatched, tracking information may be provided where available.
We remain responsible for meeting our obligations under applicable New Zealand consumer law, including obligations relating to delivery.
12. Delivery Address
Customers are responsible for providing an accurate and complete delivery address.
Please check your address carefully before submitting an order.
If an order is returned to us because an incorrect or incomplete address was provided, we may contact you to arrange redelivery. Additional delivery costs may apply where the additional cost results from incorrect information supplied by the customer, subject always to applicable law.
13. International Orders
Customers purchasing from outside New Zealand are responsible for checking whether the products they order may legally be imported into their destination country.
International orders may be subject to:
-
customs duties;
-
import taxes;
-
GST or similar taxes;
-
customs processing charges; or
-
other fees imposed by the destination country.
Where such charges are imposed by the destination country, they may be payable by the customer unless otherwise stated at checkout.
Delivery timeframes for international orders may also be affected by customs or border processing.
14. Returns
Our return procedures are set out in our Returns and Refund Policy.
Where a customer simply changes their mind, wishes to order a different size, or no longer wants the product, a return or exchange is subject to the terms of our Returns and Refund Policy.
Where a product is faulty, damaged, incorrectly supplied, not as described, or otherwise fails to meet applicable consumer guarantees, we will assess the issue and provide the remedy required by New Zealand law.
Nothing in our return policy or these Terms removes rights that cannot legally be excluded.
15. Faulty, Damaged, Incorrect, or Misdescribed Products
If you believe your order has:
-
arrived damaged;
-
arrived with a manufacturing or printing fault;
-
been supplied incorrectly;
-
materially differed from its description; or
-
otherwise failed to meet applicable consumer guarantees,
please contact us at info@moananuiwear.store as soon as reasonably possible.
Please provide:
-
your order number;
-
a description of the problem; and
-
photographs or other information that may help us assess the issue.
We may request reasonable evidence so that we can investigate the problem.
If the issue is covered by the Consumer Guarantees Act or another applicable law, we will provide the remedy required by law.
Depending on the circumstances and applicable law, this may include a repair, replacement, refund, or other appropriate remedy.
16. Consumer Guarantees Act
For customers protected by the New Zealand Consumer Guarantees Act 1993, our products are supplied subject to the guarantees provided by that Act.
These guarantees may include that products are:
-
of acceptable quality;
-
fit for purpose;
-
consistent with their description;
-
safe;
-
reasonably durable; and
-
delivered in acceptable condition and within the agreed or reasonable timeframe.
Where a product does not meet an applicable guarantee, you may have rights to a remedy.
The nature of the remedy depends on the circumstances and the seriousness of the problem.
Nothing in these Terms is intended to contract out of, exclude, restrict, or reduce any rights provided by the Consumer Guarantees Act where such exclusion or restriction is prohibited by law.
17. Fair Trading Act
Moana Nui Wear aims to provide accurate and honest information about our products, pricing, promotions, materials, manufacturing, sustainability claims, availability, and other aspects of our business.
We will not knowingly engage in misleading or deceptive conduct.
We will endeavour to ensure that advertising, product descriptions, promotional claims, and pricing information are accurate and supported by reasonable grounds where required by law.
Nothing in these Terms limits any rights or protections available under the Fair Trading Act 1986.
18. Promotions and Discount Codes
Promotional offers, discount codes, sales, competitions, and other special offers may be subject to additional terms.
Unless expressly stated otherwise:
-
promotions are subject to availability;
-
discount codes must be entered correctly at checkout;
-
discounts cannot be exchanged for cash;
-
multiple promotional codes may not be combined; and
-
promotional terms will apply for the period specified.
We reserve the right to correct obvious errors in promotional information.
Any promotion will remain subject to applicable consumer law.
19. Intellectual Property
The Moana Nui Wear name, logo, branding, designs, artwork, photographs, graphics, written content, product concepts, website content, and other original materials are owned by or licensed to Moana Nui Wear unless otherwise stated.
You may not reproduce, copy, modify, distribute, sell, publish, or commercially exploit our intellectual property without our prior written permission.
This includes copying or reproducing Moana Nui Wear artwork or designs for use on clothing, merchandise, websites, social-media accounts, advertising, or other commercial products.
20. Customer Content
If you submit photographs, reviews, comments, testimonials, or other content to Moana Nui Wear, you confirm that you have the right to provide that content and that it does not unlawfully infringe another person's rights.
Where you voluntarily submit content for possible publication or promotional use, you grant Moana Nui Wear a non-exclusive right to use, reproduce, display, and publish that content for legitimate business and promotional purposes, subject to applicable privacy laws.
We may remove or decline to publish content that is unlawful, misleading, offensive, abusive, defamatory, discriminatory, or otherwise inappropriate.
21. Third-Party Services
Our store may rely on third-party providers for services including:
-
website hosting and ecommerce functionality;
-
payment processing;
-
printing and manufacturing;
-
order fulfilment;
-
shipping and courier services;
-
analytics;
-
advertising; and
-
customer communications.
Third-party services may have their own terms and privacy policies.
We remain responsible for our own obligations to customers under applicable law, even where third-party providers assist us with fulfilment or other business functions.
22. Website Availability and Errors
We aim to keep our website accurate, secure, and available, but we cannot guarantee that it will always operate without interruption or errors.
Information may occasionally contain typographical, technical, pricing, availability, or other errors.
Where appropriate, we may correct errors and update information.
Nothing in this section permits us to avoid our legal obligations to customers or to disregard an order that has been validly accepted where doing so would breach applicable law.
23. Limitation of Liability
To the maximum extent permitted by law, Moana Nui Wear will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms excludes, restricts, or limits any consumer guarantee, statutory right, remedy, or liability that cannot legally be excluded or limited under New Zealand law.
24. Events Outside Our Reasonable Control
We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including significant natural events, severe weather, fire, flood, major infrastructure failures, courier disruptions, strikes, government restrictions, cyber incidents affecting third-party providers, or other extraordinary events.
Where such an event affects an order, we will take reasonable steps to communicate with affected customers and minimise the impact.
This section does not remove any statutory rights that apply to you.
25. Privacy
Our collection, use, storage, and handling of personal information is governed by our Privacy Policy.
By using our website and placing an order, you acknowledge that personal information is handled in accordance with that Privacy Policy and applicable privacy law.
Our Privacy Policy should be read separately from these Terms.
26. Complaints and Customer Support
We want to resolve customer concerns fairly and promptly.
If you have a question, complaint, or concern about an order, please contact:

Please include your order number and sufficient information for us to investigate the matter.
We will consider complaints in good faith and will work with customers to find an appropriate resolution.
27. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, products, services, legal requirements, or website.
The updated Terms will be published on our website with the relevant "Last updated" date.
Changes will generally apply from the date they are published and will not retrospectively remove rights that already apply to an order under applicable law.
28. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the extent necessary to make it lawful where possible.
The remaining provisions will continue to apply to the extent permitted by law.
29. Governing Law
These Terms are governed by the laws of New Zealand.
Where applicable, disputes may be subject to the jurisdiction of the New Zealand courts and tribunals.
Nothing in this section prevents a consumer from exercising any statutory right or remedy available under applicable New Zealand law.
30. Entire Agreement
These Terms, together with our applicable:
-
Privacy Policy;
-
Returns and Refund Policy;
-
Shipping Policy;
-
promotional terms; and
-
other policies expressly incorporated into our website,
form the framework governing your use of the Moana Nui Wear website and your purchases from us.
Where there is a conflict between these Terms and a mandatory requirement of New Zealand law, the mandatory legal requirement will prevail.
